Speaking only for myself, I was amused to read Hans's post written immediately after the California Appellate Court filed its carefully considered opinion. The court clearly stated that FPUSA was correct regarding all matters undertaken regarding Kurz's and Carter's umpire suspensions. It also expressed surprise that their lawyer didn't seem to understand California law regarding final judgments.
Kurz and Carter set out to destroy FPUSA. Why? You have to ask them. The impportant thing is that they failed.
Everything they claimed was rejected by the court. The appeal ruling sustained the trial judge's ruling across the board. Were their actual purpose not to destroy FPUSA, they and any reasonable lawyer would have seen this before the lawsuit was filed.
I have a long file of emails in which I offered to them the opportunity to simply apology and agree to follow the rules in the future, and they would be reinstated immediately. They chose their own route. The results of that choice are perfectly clear.
It therefore is a bit disingenuous to suggest that after you have been slammed to the ground twice and have nowhere to go in a baseless lawsuit, that you have told your lawyer to stop the litigation. What happened was that someone realized that it was time to stop kicking a very dead horse, one that was dead well before leaving its stall.
It would be absolutely wonderful were Carter and Kurz able to actually do something positive for the sport. They have been invited to do that for some years now, without any showing of positive response or results whatsoever. Only time will tell whether anything has changed. I wish them the best of success in whatever they decide to do in the future, and hope that from now on they will be a positive force for petanque in the USA.
I am keeping my fingers crossed and will be looking forward to seeing real results.
